Terms and conditions of access: individuals'Individual user' means:
Use of ePress content by individual users is subject to the terms and conditions in the following 'Individual user licence agreement'. Individual user licence agreementAccess for individual users is by user-name and password, unless the user is accessing content by virtue of an institutional subscription held by a (third party) institutional subscriber. 1. Access rights1.1 Individual users will not use Monash University ePress content directly or indirectly for any substantial or systematic reproduction, re-distribution, re-selling, loan or sub-licensing, in any form to anyone. 1.2 Individual users will not modify, adapt, transform, translate or create any derivative work based on any Monash University ePress content in a manner that would infringe the copyright or other proprietary rights therein. 1.3 Individual users will, to the best of their ability, ensure that their user-name and password are not passed to any individual or third party. Individual users will notify Monash University ePress of infringements that come to their notice and agree to cooperate with Monash University ePress as appropriate to stop further abuse should it occur. 1.4 Individual users may not assign this agreement to any other natural or legal person.2. Limitation of liability2.1 Monash University ePress does not give any warranty express or implied or make any representation that online publications will be complete or accurate or up to date. Individual users acknowledge the need to independently verify the accuracy of all instructions and formulae with primary sources for such information. 2.2 Monash University ePress shall not be liable for any loss, actions, claims, proceedings, demand for costs or damages whatsoever or howsoever caused arising directly or indirectly in connection with or arising out of this agreement, its performance or otherwise, except to the extent to which it is unlawful to exclude such liability under the applicable law.3. Availability of contentThe ePress will make all reasonable efforts to make the server available to individual users, excluding normal network administration and system down-time, but if access is suspended or interrupted, liability shall be limited to restoring access to the server as soon as reasonably practicable. 4. Refusal of accessThe ePress reserves the right to refuse access to digital content to any individual user who has not made reasonable attempts to comply with these terms and conditions for using ePress content. 5. SecurityThe ePress will treat personal cheque or credit card data efficiently and sensitively to ensure the safety of personal details. The ePress will not sell or give customer contact details to any third parties. Credit card orders made online are processed through a secure server. When the padlock at the bottom of the screen is in the locked position, the site is using SSL RC4, 128 bit encryption. Processing of the actual credit card transaction is managed by Westpac, one of Australia's major banking institutions with a strong commitment to customer service and provision of e-commerce services.
